    • "We”, “us” and “our” refers to our business entity where we trade.
    • These are the terms and conditions that apply when you purchase goods from, on, or through the website.

     

    Acceptance

    • When you purchase goods from us, you agree to and accept all our terms and conditions.
    • You agree that we may send you your invoice and other communication by electronic communication (e-mail).
    • We request that you inform us of any changes in the information you provide to us.

     

    Goods

    • The price of goods is valid and effective in South Africa only and quoted in South African Rands inclusive of Value-Added Tax (“VAT”).
    • The price of goods represents the complete retail list price and is subject to change without notice.
    • The website is not available for purchase or delivery outside the borders of South Africa.
    • We attempt to accurately display the price, description, and colour of goods on our website. However, the device you use to access the website may impact the display of our goods. We cannot be held responsible or liable for any variance in the colour displayed (as it appears on the website) and the actual colour of any goods.
    • Goods are essentially identical to the sample(s) on the website; however, due to reasonable alterations (to improve its aesthetics or appearance) goods may not be identical.

     

    Payment\e

    • Payment terms depend on stock availability.
    • You are provided with an opportunity to review the sales order, correct any mistakes, and withdraw the sales order before finally placing the sales order.
    • Goods added to an online sales order does not constitute a valid order without payment. We cannot be held liable for goods no longer available or any change in the price of goods should you decide to complete your order at a later stage.
    • We require full payment for immediately available goods.
    • Delivery fees may change (at any time) until you confirm your sales order by payment.
    • We require a deposit of 50% for made-to-order goods (with extended lead times). We will confirm the expected lead time and communicate any delays. If the lead time is extended for 30 days or more for reason(s) beyond our control, you may request a refund of the deposit.
    • Any balance is immediately payable once the goods are ready for collection/delivery.

     

    Collection, delivery, and storage fees

    • We remain the owner of goods until we receive full payment.
    • We will release the goods for collection/delivery (including release to third party courier service providers) when receiving payment clearance from our bank.
    • The collection/delivery of goods is on your own risk, and we cannot be held liable or responsible for any loss, damage, or destruction due to any reasons whatsoever.
    • We will contact you to arrange mutually suitable collection/delivery of the purchased goods.
    • If you fail to confirm any information required for the delivery/collection of goods within 10 days from payment, we will charge storage fees calculated at 10% of the sales order, per month or part thereof.
    • If we are unable to deliver the goods to you within 30 days from payment, we reserve the right to cancel your order, deduct storage fees and delivery charges and refund the balance due to you (if any) with online credit. In this instance, we will provide you with 7 days written notice.

     

    Cancellation and cooling-off period

    • We request that you consider your choice of made-to order goods as we don’t accept the cancellation of any made-to-order goods in accordance with the Consumer Protection Act, read with the Electronic Communications Transactions Act.
    • You may cancel a sales order within 7 days after receipt of the goods in respect of pre-manufactured goods. We will refund payments made, but you bear the cost(s) of returning the goods to us.
    • We charge a handling fee calculated at 10% (following the cooling-off period) of the sales order for cancellation on all pre-manufactured goods.

    No cash refunds are given, only online credit is provided.

     

    Returns and repairs

    • If goods are damaged, or defects are detected, you should report a complaint within 7 days from the date of purchase to marisa@sunbirdmarket.co.za. We will repair defects where possible. Defective goods that cannot be repaired will be replaced where necessary. This decision will be at Sunbird Market’s sole discretion.
    • Should you wish to return goods that has already been delivered and which does not display any visible defects, we will charge a handling fee calculated at 10% of the sales order. In this event, we will not refund delivery costs.
    • Returns will only be granted within 7 days of delivery.
    • Returns on made-to-order goods are not allowed.
    • Sale items cannot be returned or repaired.

     

    After-sales service and guarantee

    • We request that you carefully read and consider any measurements, care instructions and guarantees.
    • We cannot guarantee the availability of stock despite our reasonable efforts.
    • Natural cracks, scratches and markings of any leather/solid wood goods are not considered defects and form part of its natural characteristics. However, excessive cracks may render solid wood goods defective.
    • If goods are cared for properly, it may last for many years; however, we cannot provide a lifetime guarantee. Any goods will show signs of wear and tear, especially under direct sunlight conditions.
    • We urge you to immediately discuss any problems which may arise with us. We arrange on-site inspections (where necessary) and will suggest a solution following a consultation.
    • Should a defect occur within the first few weeks after purchase, it’s likely that it could be repaired. However, after longer periods, we are obliged to ask standard questions and charge an amount commensurate to the extent of the repair(s) required.
    • All repairs are done on an ex-factory basis. Therefore, we cannot cover the transportation costs.

     

    Care instructions

    Furniture

    • Minimal exposure to sunlight. Be careful about exposing wooden furniture and leather to sunlight for prolonged time periods.
    • Be mindful of temperature.
    • Let it age with grace.
    • Keep sharp objects at bay.
    • Oil and Wax Regularly.
    • Use Warm Water for cleaning.

     

    Leather

    • Leather by its nature is organic and as such contains variances and imperfections in texture, colour and appearance.
    • Do not leave in direct sun – prevent from colour changes and drying out.
    • Keep the leather in a supple condition by using a leather ‘food’ wax of cream regularly.
